Predictiv’s Website : We collect and record Data if you contact us about our Services or request a demo on our website, the forms you complete or the emails you send may include Data about you, such as your full name, your email address, the organisation on behalf of whom you are contacting us and your enquiry.

4.6. Cookies:

We might use two types of cookies- namely persistent cookies and session cookies. Persistent cookies are the ones which stay on your computer until they are deleted whereas session cookies expire once the browser is closed. 5. SHARING OF DATA

We may disclose your personal Data to our group companies, and corporate affiliates for purposes consistent with this Policy.

5.1 With third-party service providers: We may employ third-party companies and individuals to administer and provide services on our behalf to provide customer support, to host, manage, maintain, and develop our Website, and IT systems. These third parties may use your Data by us and in a manner consistent with this Policy and are prohibited from using or disclosing the Data for any other purpose.

We provide the Data to other such businesses who are in the same or similar market or are trying to establish reach with the other professionals for their own business-to-business sales, marketing, and recruiting activities.

8.2. We may use the Data for the following purposes:
  1. to administer platform log-ins (where applicable) and to deliver our services to our clients or their customers under the agreed terms of service.
  2. to process your enquiries to reply and provide support, including providing you and/or your organisation with information about Services;
  3. to consider potential candidates for possible employment with us and communicate about employment opportunities or submitted employment applications.

The Data is secured by the contractual terms and conditions we have with our partners in accordance with applicable clauses and laws that govern data protection.

  9. to send technical notices, updates, security alerts, and support and administrative messages.
  10. to facilitate contests, sweepstakes, and promotions, process entries, and deliver rewards.

  12. to conduct advertising on social networks for Predictiv, which means that if you link to one of our social media platforms you may be subject to targeted marketing displaying our ads via that site.

9. INTERNATIONAL TRANSFERS

Predictiv is based in UAE and has service providers around the world. Your Data may be transferred to and maintained outside of your country which may not have similar privacy or data protection laws. If you are located outside UAE and choose to provide Data to us, please note that we may transfer the Data to India and process it there, subject to Applicable Law. By using our Services, you ` their respective laws and policies.

In situations where our customers are subject to the GDPR and transfer Data to us, we’ve established contracts based on either the Standard Contractual Clauses approved by the European Commission or the United Kingdom International Data Transfer Agreement or Addendum, depending on the applicable jurisdiction. 10.3. We collect and retain the Data for the provision of the Services and to comply with legal, regulatory, and/or reporting requirements, as applicable. We may retain the Data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation with respect to our relationship with you. However, once the purpose has been fulfilled, we promptly and securely purge all the Data provided by you, ensuring that it is no longer accessible or retained by us.

11. THE GENERAL DATA PROTECTION REGULATION GDPR FOR EU RESIDENTS

11.1. 11.1. Predictiv is committed to ensuring compliance with the EU GDPR and UK DPA in accordance with business requirements. Our organization processes Data in strict adherence to the necessary norms and guidelines outlined by these regulations. We prioritize the protection and privacy of personal Data, implementing robust measures to safeguard information and uphold the rights of individuals. Under GDPR there are six grounds to process personal Data, these are equally valid. There are two of these which are relevant to our business which are: consent or legitimate interest. As Recital 47 of the GDPR states that “The processing of personal data for direct marketing purposes may be regarded as carried out for a legitimate interest.”
11.2. Using legitimate interest as the basis for B2B marketing involves ensuring key conditions are met:
“The processing must relate to the legitimate interests of your business or a specified third party, providing that the interests or fundamental rights of the data subject do not override the business’ legitimate interest.” “The processing must be necessary to achieve the legitimate interests of the organization.”
11.3. Predictiv operates with a dual role, acting as data controller and as a data processor, adapting to the specific nature of our collaborations. This flexible approach demonstrates a commitment to tailoring roles to specific collaborative requirements, ensuring transparency, compliance, and trust in all data processing activities.
11.4. As a ‘data processor’, Predictiv complies with the following Data privacy requirements honouring the GDPR law (Article 13 and 14):
  1. Predictiv provides notice to all data subjects as required by GDPR Article 13 or 14, as appropriate, and honours the rights of data subjects provided in Articles 12-23, including the right to be forgotten.
  2. Predictiv informs individuals about the collection and use of their personal Data, retention periods for the Data, and who it will be shared with. This is a key transparency requirement under the GDPR, provides privacy information to individuals at the time of collecting their personal Data.
  3. When Predictiv obtains personal Data from other sources, we provide individuals with privacy information within a reasonable period of obtaining the Data and no later than a month.
  4. If Predictiv obtains information about any Customer that may be considered as an EU resident for its database, it will notify such Customer. The notification will include details about the Data Predictiv has, how it will be used, and the Customer’s rights regarding their information. This includes the right to know what Data we have, to correct it if necessary, or to opt out of Data collection entirely. Customers can opt out of our database by sending an email to [email protected]
11.5. Information we provide to people is concise, transparent, intelligible, easily accessible, and in clear and plain language. We conduct regular review, and where necessary, update our privacy information. If there are any new uses of an individual’s personally identifiable Data, we make sure to bring it to their attention before we start processing.

12. CALIFORNIA CONSUMER PROTECTION ACT FOR CALIFORNIA RESIDENTS

12.1. The California Consumer Protection Act (“CCPA”) applies to any business, including any for-profit entity that collects consumers’ personal data, which does business in California, and satisfies at least one of the following thresholds
  1. Has annual gross revenues in excess of USD 25 Million.
  2. Buys or sells the personal information of 50,000 (Fifty Thousand) or more consumers or households. or

12.2. Predictiv ensures that reasonable security procedures and practices are implemented and maintained to safeguard your Data.
12.3. Predictiv complies with the CCPA by processing data along the CCPA norms as follows:
  1. Under CCPA the following are the rights of the Customers:
    1. Right to Deletion
      The Customers have a right to opt for deletion of any unnecessary Data as he may deem fit is available with Predictiv. Such Customer shall send a request to us for the same mentioning the specific Data to be deleted from the Predictiv’s database.
    2. Right to Access and Data Portability
      The Customer has a right to access the Data used and processed by Predictiv for its business including:

      1. Information Collected.
      2. Sources of Collection of Information.
      3. Purpose of the Collection of Information.
      4. Disclosure of information collected with any other third party.Predictiv shall disclose the Data collected and used upon receipt of a Customer’s verifiable request. Further, Predictiv shall informs the Customers about the collection and use of their personal Data, retention periods for the Data collected, and with whom it will be shared with. This is a key transparency requirement under the CCPA that provides for the privacy of the Customer Data at the time of collection. Along with the above compliance, Predictiv DOES NOT SOURCE any sensitive Data such as religion, political inclinations, age etc., and has an EXPLICIT OPT-IN, OPT-OUT process.
    3. Privacy Notice
      In the event, we obtain Data of Customers that is a USA resident in our database, we will notify the Customer. This notification will include details of the Data we have collected, its intended use, and the Customer’s rights regarding their information. These rights include the ability to know what Data we hold about them, to correct any inaccuracies, or to opt out of data collection entirely.Information we provide to Customers is concise, transparent, intelligible, easily accessible, and in clear and plain language. We conduct regular review, and where necessary, update our privacy information. If there are any new uses of an Customer’s personal Data, we make sure to bring it to their attention before we start processing.
    4. Right to opt out
      All Customers have the right to opt out of the sale of their personal information by Predictiv. To exercise this right, individuals can fill out the details on our “Do Not Sell My Personal Information“Additionally, the Customers have the right to opt out of receiving marketing messages and emails at any time. This can be achieved by unsubscribing from our email list using the provided mechanism in our marketing communications.
      In the event, that a Customer decides to opt out, they will continue to be eligible for the same prices and services that are offered to other Customers.
    5. Right to withdraw Consent
      Customers have the right to withdraw their consent for processing its Data at any time. However, post consent withdrawal, there may be certain Services that will be discontinued. If this situation arises, we will inform the Customer before proceeding the consent withdrawal. for consent withdrawal requests, the controller must provide information on the action taken within one month of receiving the request.This period can be extended by two months considering the complexity and number of requests.

    6. Right to modification
      Customer has rights to rectify or amend any incomplete or incorrect information that we hold about him/her. This right ensures that the Data stored about you is accurate, up-to-date, and reflective of your current circumstances or preferences. To request modifications, Customers can send an email to [email protected].

13. DISCLOSURES BY PREDICTIV

13.1. Disclosures of Public Profiles

We may share any business Data provided by the Customers for our directory, Data gathered from public websites or licensed from third parties. This Data could be made accessible to the Customers of Website, as well as to our strategic partners.

13.2. Disclosures to Service Providers

Predictiv might occasionally share business information or other collected data with service providers. This sharing is solely for them to perform functions related to operating the website and nothing else. For example, when you visit our website, these service providers might set cookies on our behalf and receive information about your browsing activity on our site.

13.3. Disclosures for Legal Reasons

If Predictiv or substantially all of our assets are acquired, or in the event of a merger or bankruptcy, Data about you and/or Data you provide to Predictiv may be among the transferred assets. You will be notified via email and/or a prominent notice on our Website of any change in ownership or uses of your personally identifiable Data, as well as any choices you may have regarding the same.

If you register for a Predictiv event with a third-party speaker, your information will generally be shared with the speaker.

14. CHILDREN’S DATA

Our Website and Services are not directed to children, and Predictiv does not knowingly collect Data from children under the age of 18.
